These Terms of Service govern your access to and use of EsperoLink, including our website, directory, planning case tools, provider tools, messaging, appointment features, obituary features, payment features, and optional Family Care Coordinator Support.

1. Acceptance of Terms

By accessing or using EsperoLink, you agree to these Terms and our Privacy Policy. If you use EsperoLink on behalf of a business, organization, provider, family, estate, or other person, you represent that you have authority to do so. If you do not agree, do not use the platform.

We may update these Terms from time to time. Your continued use of EsperoLink after updates are posted means you accept the updated Terms.

2. What EsperoLink Provides

EsperoLink helps families organize funeral-related planning cases, find approved providers, request quotes, review estimates, message providers, schedule appointments, create and manage obituaries, share planning access with authorized users, and optionally request Family Care Coordinator Support.

EsperoLink may make tools available to providers, administrators, and Family Care Coordinators. These tools are intended to support communication, organization, and administrative workflows. They do not create a professional services relationship between EsperoLink and any user unless expressly stated in a separate written agreement.

3. No Emergency, Legal, Medical, or Licensed Funeral Service Advice

EsperoLink is not an emergency service. If there is an urgent health, safety, law enforcement, medical, legal, or licensed funeral service matter, contact the appropriate professional, government office, funeral home, cemetery, crematory, clergy member, attorney, or emergency service directly.

Information on the platform is provided for planning and convenience. You should independently confirm requirements, deadlines, permits, prices, availability, contracts, religious requirements, cemetery rules, cremation requirements, transportation requirements, and other important details with the appropriate provider or professional.

4. Accounts and Access

You must provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for activity under your account unless caused by our failure to use reasonable security measures.
You may not create accounts for others unless you are authorized to do so.
You must promptly update account, provider, contact, and payment-related information when it changes.

EsperoLink may suspend, restrict, or terminate access if we believe an account is being misused, violates these Terms, creates risk for users or the platform, or is required by law.

5. Family Users and Planning Cases

Family users may create planning cases, attach quote requests, review estimates, manage appointments, create obituaries, and grant access to other authorized registered users. You are responsible for ensuring you have the right to submit, share, publish, or authorize the use of information about yourself, your family, the deceased, service details, photographs, obituary text, and related materials.

If you grant another user access to a planning case, you are responsible for choosing the appropriate access level. Users with manage access may be able to take actions on the planning case, including messaging providers, requesting quotes, viewing estimates, and editing related information.

6. Providers, Listings, Quotes, and Estimates

Providers are responsible for the accuracy of their profiles, locations, service types, pricing information, estimates, appointment availability, business credentials, licensing, insurance, service quality, and compliance with laws and professional obligations. EsperoLink may review or approve providers for platform access, but approval does not guarantee provider availability, quality, pricing, licensing status, suitability, or performance.

Quotes, estimates, price ranges, messages, and provider profile information are informational unless a provider enters into a separate written agreement with a family. Final prices, contract terms, payment terms, cancellation terms, refunds, and services are determined by the provider and the family, not by EsperoLink, unless expressly stated otherwise for an EsperoLink paid service.

Families should confirm all pricing, included services, third-party costs, dates, availability, and written contract terms directly with the provider before making decisions or payments to providers.

7. Optional Family Care Coordinator Support

Family Care Coordinator Support is optional and is not required to create a planning case, browse providers, request quotes, message providers, schedule appointments, or publish an obituary. A coordinator may help with planning organization, timelines, provider outreach, quote follow-up, obituary support, printed material coordination, venue or repast coordination, and day-of logistics planning.

Coordinators provide planning and administrative support only. They do not replace licensed funeral directors, funeral homes, crematories, cemeteries, clergy, attorneys, accountants, medical professionals, insurance professionals, financial advisors, or other licensed or regulated providers.

Family Care Coordinator Support may be refundable until a coordinator is assigned and non-refundable after work begins, subject to the details shown at checkout and any applicable law. EsperoLink may decline, cancel, reassign, or refund coordinator support when necessary to protect users, comply with law, resolve operational issues, or address misuse of the platform.

8. Payments, Billing, and Third-Party Processors

Some platform features or services may require payment. Payments may be processed by third-party payment processors such as Stripe. By making a payment, you agree to the displayed checkout terms, processor terms, and any applicable refund rules.

EsperoLink is not responsible for payment issues caused by third-party processors, banks, card issuers, network failures, incorrect billing information, or unauthorized payment methods provided by a user. Provider payments made outside EsperoLink are between the family and the provider unless expressly stated otherwise.

9. Obituaries, Comments, Photos, Memories, and Public Content

Users may create obituary pages and may post comments, memories, photos, or candle-style tributes where available. Published obituary pages may be publicly accessible and may appear in social media previews, search engines, direct links, screenshots, or shared messages.

You are responsible for ensuring you have permission to publish names, dates, photos, service information, obituary text, comments, memories, and other content. Do not post private, sensitive, defamatory, infringing, misleading, harassing, exploitative, unlawful, or unauthorized content.

EsperoLink may remove or restrict content that we believe violates these Terms, infringes rights, creates safety or privacy concerns, is reported by an authorized person, or may expose the platform or users to legal risk.

10. Communications and Notifications

By using EsperoLink, you agree that we may send service-related communications such as account emails, confirmation emails, password resets, quote request notifications, estimate notifications, message notifications, appointment updates, payment confirmations, provider approval emails, coordinator support updates, admin notices, and other transactional communications.

You are responsible for keeping your email address and contact information current. Delivery may depend on third-party email providers, spam filters, device settings, and network availability.

SMS Verification Program

Users may voluntarily enroll to receive user-requested one-time verification codes from EsperoLink. Message frequency varies according to verification requests. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is not a condition of purchase. Opting out may prevent mobile-number verification and access to features that require a verified number.

11. Ratings, Reviews, and Feedback

Family users may be able to rate providers. Ratings and comments must be honest, based on actual experience, and must not be abusive, false, defamatory, discriminatory, or unlawful. EsperoLink may moderate, remove, or restrict ratings or feedback that appear to violate these Terms or applicable law.

12. Acceptable Use

You may not:

Use the platform for unlawful, deceptive, abusive, exploitative, or harmful purposes.
Misrepresent your identity, authority, business, licensing, affiliation, services, or prices.
Access, use, scrape, copy, harvest, or export data without authorization.
Interfere with security, authentication, availability, or integrity of the platform.
Upload malware, spam, phishing content, or harmful code.
Post content that infringes intellectual property, privacy, publicity, or other rights.
Use another user's account or planning case without permission.
Bypass access controls, role permissions, payment requirements, or security checks.

13. User Content License

You retain ownership of content you submit, subject to any rights held by others. You grant EsperoLink a non-exclusive, worldwide, royalty-free license to host, store, copy, process, display, transmit, format, moderate, and use your content as necessary to operate, secure, improve, and provide the platform and services. For public obituary content, this includes displaying public pages and related social sharing preview information.

14. Intellectual Property

EsperoLink® is a registered trademark. The EsperoLink name, logo, branding, software, designs, workflows, text, graphics, and platform features are owned by EsperoLink or its licensors and are protected by applicable trademark, copyright, and other intellectual property laws. You may not use the EsperoLink name, logo, or related marks in a way that suggests sponsorship, endorsement, affiliation, or permission without our prior written consent. You may not copy, modify, reverse engineer, resell, or create derivative works from the platform except as permitted by law or with our written permission.

15. Disclaimers

EsperoLink is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, uninterrupted service, and error-free operation. We do not guarantee provider performance, provider availability, quote accuracy, estimate accuracy, appointment availability, social media previews, search engine indexing, email delivery, payment processor availability, or that the platform will meet every user's needs.

16. Limitation of Liability

To the fullest extent permitted by law, EsperoLink and its owners, employees, contractors, coordinators, affiliates, vendors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for damages arising from provider conduct, user content, inaccurate information, missed communications, third-party services, payment processors, or decisions made using the platform. Where liability cannot be excluded, it is limited to the amount paid to EsperoLink for the service giving rise to the claim during the three months before the claim, or one hundred dollars if no amount was paid, unless applicable law requires otherwise.

17. Indemnification

You agree to defend, indemnify, and hold harmless EsperoLink and its owners, employees, contractors, coordinators, affiliates, vendors, and licensors from claims, losses, liabilities, damages, costs, and expenses arising from your use of the platform, your content, your violation of these Terms, your violation of law, your services or business practices, your disputes with other users or providers, or your infringement of another person's rights.

18. Third-Party Services and Links

EsperoLink may link to or integrate with third-party services, including payment processors, email providers, maps, social media sites, video meeting links, provider websites, and analytics or security tools. We are not responsible for third-party services, websites, content, policies, availability, or actions.

19. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law rules, unless applicable law requires a different governing law. You agree to first contact EsperoLink and try to resolve any dispute informally before pursuing formal legal action.
